DESCRIPTION: These are the results of inspections of the above facilities to enforce the minimum rules of sanitation necessary to protect the public health. This activity is authorized under UCA 26-15-2. These reports include the name of the establishment; the type of establishment; the city and county where located; the number of lodging units; the secondary water source; the on-site sewage disposal type; the address of the facility; the health district; the name and address of the owner; the name and address of the leasee; the type of inspection activity (routine, complaint, etc.); the results of the inspection of the water supply, the wastewater disposal, the service buildings or rest room facilities, the housing, the laundry facilities, the swimming or wading facilities, and the solid waste facilities; the inspector's remarks; the date of the inspection; and the signatures of the owner and inspector.

Paper: Retain in Office for 2 years and then transfer to State Records Center. Retain in State Records Center for 2 years and then destroy.

Administrative Legal

A violation of the health code is a class B misdemeanor, which has a two year statute of limitations. However, if the violator has had another violation within the previous two years, the second violation becomes a class A misdemeanor. Therefore, a four year retention will be needed to ensure that the necessary information will be on hand to prosecute a violator of the code. UCA 26-23-6(1) and 76-1-302(1)(a).
