DESCRIPTION: These are the results of inspections of wastewater disposal systems to enforce the minimum rules of sanitation necessary to protect the public health. This activity is authorized under UCA 26-15-4. The report includes the address of the property, the county and city where located, the name of the owner, the name of the contractor, the case number, the number of bedrooms, the percolation test results, the required absorption area, the required septic tank capacity, the type of installation (new, existing, public, or private, absorption field, seepage trench, seepage pit, or absorption bed), the inspection activities, the results of the inspection, the reason for any rejections, and the signature of the sanitarian.

Administrative Legal
A violation of the health code is a class B misdemeanor, which has a two year statute of limitations. However, if the violator has had another violation within the previous two years, the second violation becomes a class A misdemeanor. Therefore, a four year retention will be needed to ensure that the necessary information will be on hand to prosecute a violator of the code. UCA 26-23-6(1) and 76-1-302(1)(a).
