DESCRIPTION: These files document public entitlement hearings for cases such as denial of welfare, reduction in benefits, possible fraud, and other entitlement decisions. Information includes judgment by default, notice of informal hearing, notice of support debt, administrative hearing checklist, notice of hearing, notice of appeal, subpoenas, stipulation and order, divorce decree, finding of facts and decree, orders, assignment of collection of support, written answer, attorney notes, correspondence, summons, proof of payment, affidavits, transcripts, notice of settlement, and other supporting documentation.

Legal authority for collecting, keeping, or using personal data: Because Fair Hearing covers several types of cases, the law would vary. For unemployment, we are permitted to keep records regarding wages and PII. See Utah Code 35A-4-312. For public assistance programs, employment services, the Department is responsible for determining eligibility, provide refugee services and child care assistance which requires verification of identity and legal status, and other personal information. Utah Code 35A-3-103. Fair Hearings receives this information when a party appeals a decision made on unemployment or other benefits. RETENTION
Retain for 10 year(s) after case is closed or until administrative value met, whichever is greater
