DESCRIPTION: This is the record of the inspection of businesses where food is served to ensure that they are observing proper sanitation practices. These inspections are authorized by UCA 26-15-5. This record includes the name and address of the owner or operator; the name of the establishment; the purpose of the inspection (follow-up, regular, etc.); the date by which violations identified must be corrected; the inspector's comments; and the results of the inspection of food, food protection, personnel, food equipment and utensils, water, wastewater, plumbing, toilet and hand washing facilities, solid waste disposal, insect - rodent - animal control, floors, walls, and ceilings, lighting, ventilation, dressing rooms, other operations, living quarters - laundry; the rating score; and the name of the inspector.

Paper: Retain in Office for 2 years and then transfer to State Records Center. Retain in State Records Center for 2 years and then destroy.

Administrative Legal

A violation of the health code is a class B misdemeanor, which has a two year statute of limitations. However, if the violator has had another violation within the previous two years, the second violation becomes a class A misdemeanor. Therefore, a four year retention will be needed to ensure that the necessary information will be on hand to prosecute a violator of the code. UCA 26-24-22(4) and 76-1-302(1)(a).
