42 CFR 405.1026(b) requires that medical records be kept for the period of time covered by the statute of limitations for medical malpractice. In Utah, that time is 4 years (UCA 78-14-4). However, this period can be extended if the cause for action is not discovered. A 10 year retention period will allow for potential discovery and legal action.
