Scope and Content

This series contains the county clerk's record of oaths taken by elected and appointed county officials. The oaths are recorded in a bound volume containing pre-printed forms for that purpose. The particular oath is one required by the Edmunds-Tucker Act, which had been passed by Congress on 3 March 1887. The act decreed that "as a condition precedent to the right to hold office in or under said [Utah] Territory, the officer, before entering on the duties of his office, shall take and subscribe an oath or affirmation declaring his full name, with his age, place of business, his status, whether married or single, and, if married, the name of his lawful wife, and that he will support the Constitution of the United States and will faithfully obey the laws thereof, and especially will obey the act of Congress approved March twenty-second, eighteen hundred and eighty-two [Edmunds Act] ..." and the Edmunds-Tucker Act of 1887, both of which prohibited the practice of polygamy. Furthermore, the officer swore that he was not a polygamist, nor would he "aid or abet, counsel or advise" anyone who was violating the anti-polygamy laws. The text of the oath follows very closely the language found in the Edmunds-Tucker Act. In addition to the specific information required by the law, the forms include the title of the office held, the name or signature of the officer, a notarization, the recording date, and the signature of the county clerk.
